В обсуждении темы видеорегистратора мне задали интересный вопрос про с'емку людей и в частности полицейских. Я ответил про reasonable expectation of privacy, но на всякий случай проверил, прав ли я. Оказалось что я не ошибся. Если кому интересно, как такие законы устроены в Канаде (выделено мной):

Criminal Code of Canada, 162. (1):

Every one commits an offence who, surreptitiously, observes – including by mechanical or electronic means – or makes a visual recording of a person who is in circumstances that give rise to a reasonable expectation of privacy.

The first thing to understand is the difference between public and private property and how it applies to permission.

Scenario 1: Public property accessible by anyone – sidewalks, parks, roads, etc.

In scenario 1 you do not need any permission to capture images or audio of any person or anything visible from the public space, including children or police, regardless of what people may have you believe; there is no expectation of privacy (with limits, upskirt photos violates the expectation of privacy) on public property. How you end up using that image may be subject to Intellectual Property laws, such as taking a picture of someone legally on public property and then putting them on your billboard as a spokesperson without their permission.

Basically if you can see it from public space, you can record it.

Photographing and filming police officers in Canada

The Ottawa Citizen has a very good editorial on the practice of police intimidation of citizens who use their cellphone cameras and other devices to record the police.

Here's a summary of what Canadians should know about this:

There is no law in Canada that prevents a member of the public from taking photographs or video in a public place (other than some limitations related to sensitive defense installations);
There is no law in Canada that prevents a member of the public from taking photographs or video of a police officer executing his or her duties in public or in a location lawfully controlled by the photographer (in fact, police officers have no privacy rights in public when executing their duties);
Preventing a person from taking photos or video is a prima facie infrigement of a person's Charter rights;
You cannot interfere with a police officer's lawful execution of his or her duties, but taking photos or videos does not, in and of itself, constitute interference;
A police officer cannot take your phone or camera simply for recording him or her, as long as you were not obstructing;
These privileges are not reserved to media -- everyone has these rights;
A police officer cannot make you unlock your phone to show him or her your images; and
A police officer cannot make you delete any photos.

У нас на бэк-ярде (как-то стремно говорить "задний дворик", так и не знаю как это называть по-русски) в большой кадке для клубники зайчиха вырыла нору, которую нашла Саша - а там под веточками и пухом были видны зайчата! Они были живые, но мамы вокруг не было. Я позвонил в Humane Society и мне сказали не трогать их, зайчиха кормит их раз в сутки, обычно ночью. Они заберут только если их енот покалечит. Девочки счастливы, а мы немного напряглись - если зайчата не выжили бы, могло быть сложно... И вот два дня они скачут у нас по травке, а вчера я успел даже заснять как прямо перед дверью зайчика кормила молоком пятерых зайчат одновременно! Ну посмотрите только! Выбирайте в YouTube качество 1080p.
